By registering for, accessing, or attending any webinar organized by ROC.PH Digital Marketing Services, participants agree to comply with this policy. This agreement is governed by Philippine laws and applies to all webinar attendees, speakers, and organizers.
2. Purpose
This policy outlines the guidelines and expectations for hosting, attending, and participating in webinars organized by ROC.PH Digital Marketing Services. It ensures a professional, engaging, and productive environment for all participants while adhering to relevant Philippine laws.
3. Registration and Access
- Participants must register through the official ROC.PH registration link to receive access details.
- Registration details should be accurate and up to date.
- Access links are unique to each registrant and should not be shared.
- ROC.PH reserves the right to approve or decline registrations based on relevance to the event.
4. Webinar Conduct
- Participants must maintain professional and respectful behavior throughout the session.
- Disruptive behavior, such as inappropriate language, trolling, or spamming, is strictly prohibited.
- Participants should mute their microphones unless given permission to speak.
- The use of video is optional unless required by the event organizers.
- Questions should be submitted via the Q&A feature or as instructed by the host.
5. Recording and Privacy
- Webinars may be recorded for training and promotional purposes. By participating, attendees agree to the use of their contributions in ROC.PH’s marketing and training materials.
- Participants are not permitted to record, screenshot, or distribute webinar content without prior approval.
- Personal information shared during the webinar must be handled responsibly and in compliance with the Data Privacy Act of 2012 (RA 10173).
6. Technical Requirements
- Attendees are responsible for ensuring they have a stable internet connection and compatible devices.
- ROC.PH will provide technical support before and during the event but is not liable for individual connectivity issues.
- Recommended browsers: Google Chrome, Mozilla Firefox, Microsoft Edge.
7. Cancellation and Rescheduling
- ROC.PH reserves the right to reschedule or cancel a webinar due to unforeseen circumstances.
- Registered participants will be notified via email in case of changes.
- If an attendee cannot attend, they should notify ROC.PH in advance.
8. Refunds and Cancellation
- If a paid webinar is canceled by ROC.PH, registered participants will receive a full refund.
- A 50% partial refund will be issued if a cancellation request is made at least one day before the event.
- No refunds will be issued for cancellations made on the day of the event or for no-shows.
- In cases of rescheduled webinars, participants will have the option to attend the new session or request a refund within a specified period.
- Refund policies adhere to the Consumer Act of the Philippines (RA 7394) to ensure transparency and fair transactions.
9. Online Course Recording Access
- Participants can purchase an online course recording separately after the event.
- Alternatively, participants may opt for a Ticket Pass that includes both webinar access and the online course recording.
- Pricing for online course recordings will be specified in the event details.
- Access to recordings will be granted for a limited time as indicated in the event terms.
- Unauthorized reproduction, sharing, or distribution of course recordings is prohibited under the Intellectual Property Code (RA 8293).
10. Intellectual Property Rights
- All webinar materials, including slides, videos, and resources, are the intellectual property of ROC.PH.
- Unauthorized use, reproduction, or distribution of webinar materials is strictly prohibited under RA 8293.
11. Compliance with E-Commerce and Cybercrime Laws
- All online transactions, including webinar registrations and payments, comply with the E-Commerce Act of 2000 (RA 8792).
- Any fraudulent activities, hacking attempts, or unauthorized data breaches will be dealt with under the Cybercrime Prevention Act (RA 10175).
12. Legal and Compliance Risks
- Defamation and Libel Risks: ROC.PH is not liable for any statements made by speakers or participants that may be considered defamatory. The opinions expressed in webinars do not necessarily reflect those of ROC.PH.
- Contractual Obligations and Disputes: ROC.PH reserves the right to enforce agreements with guest speakers, sponsors, and partners to prevent last-minute cancellations or disputes.
- Trademark and Branding Restrictions: The use of third-party logos, images, or brand names during webinars must comply with RA 8293 to avoid trademark violations.
- False Advertising and Misrepresentation: All promotional materials for webinars must be truthful and comply with the Consumer Act (RA 7394) to avoid misleading claims.
- Tax Compliance: ROC.PH adheres to tax regulations set by the Bureau of Internal Revenue (BIR) for ticket sales and revenue from webinars.
13. Accessibility for PWDs
- ROC.PH aims to make webinars accessible to persons with disabilities in accordance with the Magna Carta for PWDs (RA 7277).
- If closed captions, sign language interpretation, or other accessibility features are needed, requests must be made at least 5 business days before the webinar.
14. Security Measures for Payment Fraud Prevention
- ROC.PH verifies all paid webinar registrations through secure payment gateways compliant with RA 8792 (E-Commerce Act of 2000).
- Fraudulent transactions, chargebacks, or unauthorized payments will result in:
- Suspension of access to the webinar.
- A formal report to the financial institution.
- Legal action in compliance with the Anti-Cybercrime Law (RA 10175).
15. Misuse of Webinar Content and AI-Generated Manipulation
- Unauthorized AI-enhanced modification (deepfake videos, voice cloning, or AI-generated impersonations) of webinar content is strictly prohibited.
- ROC.PH reserves the right to take legal action against individuals misrepresenting webinar content.
16. Ethical AI Use in Webinars
- Any AI-generated content used in webinars (e.g., automated transcripts, AI-assisted Q&A) will be transparently disclosed to participants.
- ROC.PH does not permit AI tools to misrepresent or manipulate webinar content in a misleading manner.
17. Conflict of Interest and Speaker Disclaimer
- Guest speakers must disclose any conflicts of interest (e.g., business affiliations or sponsorships).
- The views and opinions expressed by guest speakers do not necessarily reflect the official stance of ROC.PH.
18. Force Majeure Clause
ROC.PH shall not be held liable for any failure or delay in executing the webinar due to circumstances beyond its control, including:
- Natural disasters (earthquakes, floods, typhoons, etc.).
- Power outages and internet disruptions.
- Acts of government or legal restrictions.
- Cyberattacks or security breaches on third-party webinar platforms.
19. Certificates of Attendance and Participation
- Certificates will be sent via email after the event.
- If a printed certificate is needed, additional fees may apply.
20. Governing Law and Dispute Resolution
This agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from this policy shall be settled through amicable negotiations. If unresolved, disputes shall be brought before the proper courts in Cavite, Philippines.
21. Compliance and Enforcement
- Violation of this policy may result in removal from the webinar and a ban from future ROC.PH events.
- ROC.PH reserves the right to take legal action against individuals violating intellectual property, data privacy, or cybersecurity laws.
22. Data Breach and Cybersecurity Risks
- ROC.PH follows strict cybersecurity protocols to protect attendee data from unauthorized access, hacking, or breaches.
- In the event of a data breach, affected users will be notified within 72 hours in compliance with the Data Privacy Act (RA 10173).
- Participants must not attempt to hack, exploit, or interfere with ROC.PH’s webinar systems, or they will be subject to legal action under the Cybercrime Prevention Act (RA 10175).
23. Liability and Indemnification
- ROC.PH is not responsible for:
- Technical failures caused by third-party webinar platforms.
- Loss of data due to user error or system crashes.
- Any damages, financial or otherwise, resulting from advice or discussions in the webinar.
- By attending the webinar, participants agree to indemnify ROC.PH against any claims arising from their participation.
24. Third-Party Services and External Links
- Some webinars may contain links to external resources, software, or third-party services.
- ROC.PH does not endorse nor is it responsible for the accuracy, security, or privacy policies of third-party websites.
- Participants are advised to exercise caution when accessing external links.
25. No Guarantees or Warranties
- ROC.PH does not guarantee any specific business results, revenue growth, or personal success from attending webinars.
- Information shared in webinars is for educational purposes only and should not be considered legal, financial, or professional advice.
26. Ethical AI and Deepfake Prevention Clause
- ROC.PH strictly prohibits the unauthorized use of AI tools to generate deepfake versions of speakers, clone voices, or modify webinar content.
- Any AI-altered materials misrepresenting ROC.PH or its webinars will be subject to legal action under RA 8293 (Intellectual Property Code) and RA 10175 (Cybercrime Prevention Act).
27. Sponsorship and Advertising Disclosures
- Sponsored content and promotions in webinars will be clearly disclosed.
- ROC.PH does not endorse third-party brands unless explicitly stated.
28. Governing Language
- This policy is written in English and shall be the governing version in case of translation discrepancies.
29. Force Majeure Clause
- ROC.PH shall not be held liable for webinar cancellations, delays, or technical failures caused by unforeseen events, including but not limited to:
- Natural disasters (earthquakes, floods, typhoons)
- Power outages or internet disruptions
- Government regulations, lockdowns, or public emergencies
- Platform outages beyond ROC.PH’s control (Zoom, Google Meet, etc.)
30. Code of Conduct for AI and Chatbot Use
- If ROC.PH integrates AI-powered chatbots during webinars:
- AI interactions are strictly for customer support and FAQs.
- AI responses should not be considered legal, financial, or professional advice.
- Any AI-generated misinformation should be reported to ROC.PH immediately.
31. Anti-Harassment and Anti-Discrimination Policy
- ROC.PH maintains a zero-tolerance policy for harassment, discrimination, or hate speech based on race, gender, religion, disability, or sexual orientation.
- Violators will be immediately removed and may be banned from future events.
32. Multi-Jurisdiction Compliance (For international attendees)
- Webinars may be attended by individuals from different countries. ROC.PH aims to comply with:
- GDPR (General Data Protection Regulation) for EU participants.
- CAN-SPAM Act for US-based email communications.
- Personal Data Protection Act (PDPA) for Singaporean participants.
- Attendees outside the Philippines are responsible for ensuring their participation does not violate local laws.
33. Affiliate and Referral Programs
- If ROC.PH offers referral bonuses or affiliate programs:
- Commissions are subject to local tax laws and must be declared accordingly.
- Fraudulent referrals (e.g., fake sign-ups) will result in disqualification.
- Payouts are processed based on ROC.PH’s internal review and payment schedules.
34. Social Media Sharing and Hashtag Usage
- Attendees are encouraged to share insights using official hashtags (e.g., #ROCWebinars).
- However, sharing misleading, offensive, or unauthorized clips from the webinar may result in legal action.
35. Right to Modify Policy
- ROC.PH reserves the right to modify this policy at any time.
- Updates will be announced on ROC.PH’s official website and email list.
